Purpose and Reason:

This rule has been amended to reflect the following: • The Standard Utility Allowance (SUA) has increased from $556 to $576 • The Maximum Excess Shelter Deduction has decreased from $459.00 to $458.00 • The Minimum Standard Deduction four household sizes 1 through 3 has increased from $141 to $142 per month • Clarification that households must meet the 185% or 200% (for elderly and disabled households) Gross Monthly Income Standard in order to be eligible for a TANF-funded service, and will receive a benefit as long as the normal benefit calculation results in a positive benefit amount. Households which would not receive a benefit will be denied. • One and two person households that are categorically eligible do not have to meet the net income standard in order to be eligible for the minimum monthly benefit. • If a household fails to provide sufficient information or verification of a deductible expense, a request for documentation is issued. If the client does not respond within the 10 day timeframe with required documentation to support the change, the case continues to be processed. Existing verified deductions in the case record for the certification period under review are used in the calculation of benefits for reported increases that are not verified. Reports of a decrease in a deductible expense are changed without required verification. • Rules relating to the Notice of Expiration have been modified as process has changed due to the automation of the form. Technical revisions: removed outdated example from 1038.35.05; changed references from the Food Stamp Program (FSP) to the Supplemental Nutrition Assistance Program (SNAP) where applicable. In addition, the following sub sections have been added to Section 1038 as they were erroneously omitted with the last filed amendments: 1038.07; 1038.10; 1038.17; 1038.19; 1038.20; 1038.20.05; 1038.20.10; 1038.35; 1038.35.05; 1038.35.10; 1038.35.15; 1035.20; 1038.40 and 1038.40.05. A technical revision was made to Section 1038.40, changing the minimum benefit from $14.00 to $16.00 as previously promulgated.
